Terms of Service

These Terms govern your use of BetterSex (the “Service”), operated by Secure Medical Inc. By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility & age requirement

You must be at least 18 years old (or older where your local law requires) to access or use BetterSex. The Service contains adult, sexually themed material and is not intended for minors. You agree not to permit any minor to access your account or device while the Service is in use. We reserve the right to request age verification and to terminate accounts we reasonably believe belong to a minor.

2. Accounts

You are responsible for the information you provide at registration, for keeping your password secure, and for all activity under your account. Provide accurate information and keep it current. Notify us promptly at help@bettersex.com if you believe your account has been compromised. One person may not maintain multiple accounts to evade limits, bans, or billing obligations.

3. What the Service is

BetterSex provides interactive, AI-generated companions for private, fictional conversation and roleplay between consenting adults. The companions, their personalities, images, and messages are generated by software. They are not real people, are not a substitute for professional advice (medical, legal, psychological, or otherwise), and should not be relied upon as such.

4. AI-generated content & companions

All companion imagery and text on the Service is generated by artificial intelligence. Any resemblance between an AI-generated character and a real person is unintended and coincidental. AI output can be inaccurate, inconsistent, or unexpected; you use it at your own discretion. You may be able to create custom companions using the tools we provide. You are responsible for the inputs you submit, and all custom companions must depict adults. See our 2257 Statement for details on the nature of the content.

5. Acceptable use

You agree not to:

• Use the Service if you are under 18, or attempt to involve a minor in any way;
• Attempt to make a companion depict, role-play as, or be described as a minor;
• Reverse engineer, scrape, overload, or interfere with the Service or its security features (including rate limits, quotas, or content safeguards);
• Resell, redistribute, or publicly perform content from the Service except as expressly allowed;
• Use the Service to harass, defame, or harm others, or to violate any law.

6. Strictly prohibited content

Regardless of any other provision, the following are never permitted on the Service, and we enforce against them in code and by policy:

• Any sexual content involving minors or anyone depicted, described, or implied to be under 18 — this is a zero-tolerance rule with no exceptions;
• Content depicting non-consensual acts presented as real or desirable, incest, or bestiality;
• Content that promotes, threatens, or facilitates real-world violence or illegal activity.

We may report illegal content to the appropriate authorities and the National Center for Missing & Exploited Children (NCMEC) as required by law.

7. Subscriptions, tokens & billing

Paid plans and token packs are billed through our payment processor, Stripe. Secure Medical Inc is the merchant of record for those transactions; Stripe's terms apply to the processing of your payment. Subscriptions renew automatically for the stated period until cancelled. Tokens are a prepaid, limited license to access certain features; they have no cash value, are non-transferable, and except where required by law are non-refundable once spent. Prices and plan features may change prospectively. You can manage or cancel your plan from your account, and you can reach billing support at help@bettersex.com.

8. Intellectual property

The Service, including its software, design, trademarks, and our pre-made companions, is owned by Secure Medical Inc or its licensors and is protected by law. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service for your own enjoyment. Subject to applicable law and our rights above, you retain your interest in the original text inputs you provide.

9. Suspension & termination

We may suspend or terminate your access at any time for violation of these Terms, suspected fraud or illegal activity, or to protect the Service or others. You may stop using the Service and request account deletion at any time (see our Privacy Policy). Sections that by their nature should survive termination will survive.

10. Disclaimers

The Service is provided “as is” and “as available,” without warranties of any kind, express or implied, to the fullest extent permitted by law. We do not warrant that the Service will be uninterrupted, error-free, or that AI output will be accurate or suitable for any purpose.

11. Limitation of liability

To the maximum extent permitted by law, Secure Medical Inc and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the three months before the claim or USD $100.

12. Governing law

These Terms are governed by the laws of the State of Arizona, USA, without regard to its conflict-of-laws rules. The exclusive venue for disputes will be the state or federal courts located in Arizona, and you consent to their jurisdiction, except where applicable law gives you the right to bring a claim elsewhere.

13. Changes to these Terms

We may update these Terms from time to time. Material changes will be reflected by the “Last updated” date above and, where appropriate, by notice within the Service. Your continued use after an update means you accept the revised Terms.
