Why the record-keeping requirements do not apply

The record-keeping and labeling requirements of 18 U.S.C. §§ 2257 and 2257A apply to depictions of actual human beings engaged in sexually explicit conduct. Because the characters on BetterSex are wholly computer-generated and no real person is ever depicted, there are no real performers for whom age-verification records could exist, and the statute’s record-keeping obligations are not triggered by this content.

All depicted characters are adults

Every character generated or made available on the Service is created and presented as a fictional adult, 18 years of age or older. We do not permit the creation or depiction of any character that is, appears to be, or is described as a minor. This rule is enforced through multiple layers: the companion builder offers only adult options, automated screening blocks inputs that suggest a minor, and the underlying prompts require all characters to be adults.

Zero tolerance for child sexual abuse material

BetterSex has a zero-tolerance policy toward any content that sexualizes minors, whether real or fictional. We act to detect and block such material and will report apparent child sexual abuse material to the National Center for Missing & Exploited Children (NCMEC) and to law enforcement as required by law.
